Terms and Conditions – Crafting Crime Writing Course

Before you pay for and enrol on the Crafting Crime Writing Course, we ask that you read these terms and conditions. The Crafting Crime Writing Course is provided to you by Dea Parkin trading as Fiction Feedback (‘Fiction Feedback’).

  1. Contract

When a participant (“you”, “your”) have paid for and enrolled on the Crafting Crime Writing Course (‘the Course’), Fiction Feedback (“we”, “us”, “our”) will send you written confirmation of your enrolment by email. This will form a contract between you and Fiction Feedback, which incorporates these terms and conditions. For the avoidance of doubt, your contract and legal relationship is not with Martin Edwards and any queries should be addressed to Fiction Feedback and not to Martin Edwards.

  1. Enrolment on the Course

(i) Information about Course content is provided in the Course listing on our website https://craftingcrime.com/course-content/ and the Course will be delivered on our platform https://www.craftingcrime.co.uk subject to any circumstances beyond our control. By enrolling on our Course, you are confirming that you have received sufficient information and have deemed the Course suitable for you.

(ii) Once you have enrolled on the Course and paid the Course fee, we will send you an email to confirm your enrolment with a unique password to enable you to gain access to the Course. The access to our Course material is for you and you alone. You agree not to allow any third party to access the Course at any time whether via your password or by sharing file material or by any other means, and you agree to keep your password confidential at all times.

(iii) We will provide instructions for the use of the Course and any difficulties in accessing the Course materials should be reported here. We will endeavour to resolve any serious difficulties within a reasonable period of time. However technical support will not generally be available outside UK office hours (Monday to Friday, 9 am-5 pm). You accept that the Course and the website may occasionally be unavailable in order that we can carry out necessary maintenance. You agree that we may move the Course to a different platform in the event of serious malfunction of the current platform in order that you can continue to access the Course. In that event we will notify you. We will not be responsible for interruption of service due to events beyond our control, such as but not limited to failure of telecommunications links. Any technical problems relating to your computer or other equipment and their compatibility with the Course website are your responsibility.

(iv) We reserve the right to refuse to enrol any prospective student on our Course for any reason. In the event we refuse enrolment, we will promptly refund the Course fee if you have already paid it.

(v) The Course is open to those aged 18 and over. By enrolling on the Course you declare you are aged 18 years or over.

  1. Taking part in the Course

(i) Provided you pay the Course fee in full before enrolment and comply with these terms and conditions – and unless prevented from doing so by circumstances beyond our control – we will deliver the Course as described on the website. We reserve the right to alter or update the content of the Course at any time should we consider it appropriate.

(ii) You are entitled to seek a critique from Fiction Feedback (‘critique’) at any time during the six months after you enrol on the Course (or during a further period of one month if you request an extension of time which is agreed by Fiction Feedback). We strongly recommend that you study the Course materials carefully before so doing in order to gain the appropriate benefit from the Course.

(iii) The material you submit to Fiction Feedback for critiquing may comprise the opening section of your crime novel (maximum 8000 words) and a synopsis of the whole novel (maximum 1000 words). The material must be typewritten and submitted by email to cccritique@fictionfeedback.co.uk. Fiction Feedback will email you to acknowledge receipt. If you have not received an email acknowledgement within four working days, please query this with us.

(iv) Fiction Feedback will supply you with a critique written either by Dea Parkin or one of her experienced team within five weeks of acknowledging receipt and usually sooner. For the avoidance of doubt, Martin Edwards does not supply critiques. In exceptional circumstances, Fiction Feedback may advise you that supply of the critique will be delayed for a short period.

(v) You must not submit material, images or written content which might reasonably be deemed to be impolite, offensive or abusive or which is/are unlawful or that infringe the rights of any third party.

(vi) You undertake that any material that you submit to us is your own work, unless otherwise stated, and does not infringe the copyright or intellectual property rights of any third party.

(vii) On receipt of the Critique, if you have any queries about the content of the Critique, you may raise them by email within 14 days. You are welcome to purchase further critiques or other editorial services from Fiction Feedback (and do remind us you are a Crafting Crime customer) but they do not form part of the Course.

(viii) We reserve the right to amend the Course materials at any time to ensure that they are current and relevant.

(ix) We do not make a commitment that you will obtain any particular result in terms of publication or otherwise from participation in the Course.

  1. Cancellation, Withdrawal and Refunds

(i) Once you have paid your enrolment fee, you will not be entitled to withdraw from the Course or to receive any refund except in the circumstances expressly described in these terms and conditions.

(ii) We reserve the right at any time to exclude you from the Course without refund of your fee, in the event that you breach any of these terms and conditions or if we find that you have given us information which is untrue or seriously misleading.

(iii) We may cancel the Course at any time. In that event, we will refund the fee of any participant who has enrolled in the Course during the six months prior to the date of cancellation and who has not received a critique from Fiction Feedback.

  1. Data Protection

(i) Personal data you provide as part of your enrolment in and participation on our Course will be used only as set out in these terms and conditions and our Privacy Policy.

  1. Intellectual Property

(i) You own the copyright and intellectual property in all of your original material. We will not attempt to assert proprietorship over any work that is produced as a result of your participation in the Course. You must respect the integrity and provenance of the Course material and must keep confidential and private any information which has been disclosed to you within the Course.

(ii) Fiction Feedback is a business trading name of Dea Parkin. The Course results from a collaboration between Dea Parkin trading as Fiction Feedback, Competitive Edge Writing & Marketing Ltd, and Martin Edwards. The intellectual property in all parts of the Course is owned by Dea Parkin and Martin Edwards. Copyright in the Critique is owned by Fiction Feedback.

(iii) We grant you a non-exclusive, non-transferable licence to access Course materials for the sole purpose of studying for the Course and for a period of six months (‘the Course Duration’) for which you have paid. The Course Duration may at our discretion be extended by a maximum period of one month should you make a written request. You may print single copies of Course materials for your personal use in connection with a Course only. You undertake that you will not republish or make public the Course material or any part of it or the Critique on the internet or elsewhere or make any other use of our Course material without our prior written approval. You agree that breach of this undertaking will result in your being liable to pay compensation.

  1. Payment

You agree to pay the Course fee in full before enrolment. The Course fee covers all parts of the Course. All fees are quoted in UK pounds sterling.

  1. Miscellaneous

(i) Our failure to enforce a right does not result in a waiver of such a right.

(ii) If any of the provisions of these terms and conditions are held to be invalid or unenforceable by any court having authority to determine such issues, the remaining terms will not be affected.

(iii) These terms and conditions shall be governed by and construed in accordance with English law and the parties hereby submit to the exclusive jurisdiction of the English courts.

(iv) We make no warranty or guarantee that the website or any part of the Course materials or other information provided by us complies with laws other than English law.

(v) This is the entire agreement between us and you and it over-rides any verbal or written communications which are in conflict with it unless we specifically state otherwise and make reference to this sub-clause.
